Can we charge doctors who conduct abortions with murder?

Not in the US, because murder is defined as an unlawful taking of another’s life, whereas currently abortion is not considered unlawful, but rather a legitimate medical procedure.

Those two “doctors” had been starting late-term abortions in New Jersey and then driving down to Elkton to finish them. There are lawyers who can explain the loopholes they were exploiting in both states’ laws, but I can’t.

Traditionally, abortion had not been considered murder in Common Law nations. In the United States, many abortions are legal, so, of course, no crime is being committed. Even those that are done under punishable circumstances would not be treated as murder.

It is possible that some nations may consider abortion murder, but it does not seem that is the case in Western nations.
